1. Terms of Service Definitions

"Package": Any container intended to pack and preserve the Goods and given to the Carrier by the Customer.

"Editor": the company LABAL SAS.

"User(s)": any Internet user connecting to the Site, accessing one or more pages of the Site.

2. Purpose

These General Conditions of Use are intended to govern the use of the Website: www.www.moncourrierdefrance.com

It is expressly agreed that the mere fact of accessing or consulting one of the pages of the Site constitutes pure and simple and unreserved acceptance of all of these General Conditions of Use.

3. Access to the Site

Any User with Internet access can access the Site free of charge. All costs for access to the Site are borne by the User (Internet connection, computer equipment, etc.).

The Site is accessible at any time, subject to cases of force majeure and regular maintenance operations.

The User expressly agrees to access the Site using recent equipment, not containing viruses and with an updated latest generation browser.

4. Description of the Site

The Site offers a connection service between different partner carriers and Users, natural or legal persons, so that the latter can benefit from preferential rates for sending their Parcels.

The purchase made is governed by the General Conditions of Service.

5. Modalities for creating an account

Adult Users with full legal capacity have the option of creating a customer account on the Site.

In order to create an account, Users will need to fill in the following information:

→ Company name (optional)

→ Address

→ Country/Region

→ Phone number

→ e-mail

Users must also choose a strictly personal and confidential identifier and password.

To allow registration on the Site and the creation of an account, the User undertakes to provide all the mandatory information concerning him required in the registration form. If the mandatory questions are not answered, the User will not be able to validate the creation of his account.

Each User agrees to communicate only information that is specific to him, accurate and up-to-date and that does not infringe the rights of third parties or that is contrary to public order and morality.

The Publisher may ask each User to confirm the information transmitted. If the User communicates erroneous information or refuses to comply with the Publisher's requests for proof, the latter may suspend the User's access to the account.

The information communicated to the Publisher by each User as part of his registration is strictly confidential. The User's username and password are personal to him and remain under his sole responsibility. For this reason, the User must take all necessary precautions to ensure their confidentiality.

6. Responsibilities

6.1. From the Editor

The Publisher cannot be held liable in the event of damage caused to the User, to third parties, and/or to the User's computer equipment resulting, directly or indirectly, in particular:

→ Violation by a third party of the provisions of articles 323-1 to 323-7 of the French Penal Code repressing attacks on automated data processing systems, or practices of piracy (in English, "hacking") of the Site or Contents;

→ A case of force majeure preventing the Publisher from providing access to the Site.

6.2. From User

The User guarantees to use the Site in good faith, in compliance with the laws and regulations in force, these General Conditions of Use, the General Conditions of Service and the Privacy Policy of the Site.

7. Intellectual Property

The website www.www.moncourrierdefrance.com and all of its elements (in particular, general structure, texts, images, whether animated or not, videos, sounds, and, in general, any constituent element of the site) are the exclusive property of the Publisher and are protected by copyright (articles L. 111-1 and following of the Intellectual Property Code) and industrial property (rights to databases, trademarks, designs and models, etc. ).

13. Dispute Resolution

In the event of failure of the prior conciliation between the parties, and/or the prior mediation, the Courts of Paris will have EXCLUSIVE jurisdiction to settle the disputes, claims or disputes related to the Site by applying exclusively and imperatively the only French legislation, and this , regardless of the location or nationality of the Customer, and despite any warranty claim.
